Republic
Act 8792 otherwise known as the Electronic Commerce Act of 2000
under sections 27 and 28, which prescribes that within two (2)
years from the effectivity of the Act, all agencies of the government
shall be required to use electronic data messages, electronic
documents, and electronic signatures and to promote the use of
the same in the government and to the general public.
Republic Act No. 9165, “The
Comprehensive Dangerous Drug Act of 2002” impelled the Department
of Health (DOH) to protect the health of the public particularly
through the regulation of Drug Testing Centers’ operation.
The same issuance specifically prescribes mandatory drug test
for applicants of driver’s license.
The
Land Transportation Office (LTO) issued Memorandum Circular EMA-MC-01338-A
that required all accredited drug test laboratories to connect
on line with the LTO Information Technology System. Such authority
over Drug Test Centers (DTCs) was however relegated to the DOH.
And hence, the DOH must provide a mechanism that would assure
connectivity to the said system and other similar systems dependent
to DOH regulated data output to preclude disjointed public service
arising from technological designs.
